Health Guarantee / Contract

Buyer's Responsibilities:

You must have puppy examined by a licensed veterinarian within 72 hours of delivery. Seller must be informed immediately of the examination's result by email or by fax. The failure of this will result in the cancellation of this guarantee.

Provide puppy with routine preventive care, such as, but not limited to:
Follow veterinarian guidelines for vaccinations and de-worming. With the following Exception: "Puppy must not receive a vaccination within 7 days of arriving at its new home." That means he/she cannot receive a vaccination on your first trip to the vet. The stress of coming to their new home and the flight is stress enough. Also, if you choose to have your puppy given the Lepto vaccine then this health guarantee is void due to fatal side effects. Failure to follow these instructions will make this contract null and void.

All deposits are non-refundable.

Failure to keep your new puppy on the same type of food could result in diarrhea, loss of appetite, hypoglycemic attacks (low blood sugar) or a combination of these symptoms.

With a new puppy comes extra  responsibilities. Failure to follow these guidelines could put your puppy in serious danger.

Because of all genetic and environmental factors involved, we cannot guarantee that your puppy will be without hereditary defects. HOWEVER, we have done our best to avoid passing on any undesirable traits by having both parents tested and are free, as far as it is possible to determine, undesirable genetic characteristics.

With this said, if a puppy should develop any hereditary characteristics, such as crippling hip dysplasia, hereditary heart or eye conditions, before the age of twenty six months, that will affect the puppy’s life or physical abilities, we will replace the puppy as soon as possible. (Replacement puppy may not be available until our next planned litter). If a problem should arise, we require that you take your puppy to a board certified veterinarian for a diagnosis. If it is found that the puppy does indeed have a life altering genetic disorder a second opinion is required for the final diagnosis. The second opinion board certified vet must be chosen by the breeder or approved by the breeder PRIOR to taking the puppy in.

Two Year Health Guarantee against Genetic Defects:
This puppy is guaranteed until one year of age against fatal congenital disease which adversely affects the health of the animal. This includes kidney, heart, pancreas, spine, and liver problems of a severe life threatening nature. If the dog dies within this one year time frame, the buyer will pay to have it autopsied by a licensed veterinarian to ascertain reason. If reason is congenital, the Seller will replace the puppy. All veterinarian findings must be submitted and signed by a licensed Veterinarian and be sent on the Veterinarian's letterhead.  Puppies commonly have benign heart murmurs, which disappear by roughly 6 months of age. These puppy murmurs typically are not cause for concern and are not covered.
All items covered under this guarantee are by replacement only. We do not give refunds.
Seller will not be responsible for any medical expenses incurred. Buyer is aware that owning a puppy means trips to the veterinarian and understands that he/she will be responsible for all payments.
As of the date of delivery, the puppy has received proper vaccinations and worming. A DETAILED RECORD OF YOUR PUPPY'S HEALTH & VACCINATIONS IS INCLUDED IN YOUR PUPPY PACK. PLEASE TAKE THIS WITH YOU TO YOUR FIRST VISIT TO YOUR VET TO MAKE SURE YOUR VET DOES NOT GIVE A VACCINATION THAT HAS ALREADY BEEN GIVEN!

No guarantee is given for any kind of worm, coccidia, or giardia. These parasites are all too common to pups and can be contracted from your soil or boarding facility. Your puppy has been wormed frequently from two weeks of age until your possession. It is your responsibility to continue to worm your puppy and check for parasites. Your puppy should be wormed every two weeks until it is placed on a monthly heartworm preventative (Required). Internal flea preventatives are not acceptable and will void your guarantee. Vectra 3D or Advantix is recommended for flea prevention.

Vaccination must be no less than three weeks apart and no more than four weeks apart for a series of three. Rabies vaccines cannot be administered before 16 weeks of age. If you allow your veterinarian to do any of these vaccinations too early, your guarantee is void. Also, if you choose to have your puppy given the Lepto vaccine then this health guarantee is void due to fatal side effects.

A puppy with a defect must be returned to the seller to qualify for a replacement puppy. NO REFUND, in part or in full, will be given. A returned puppy must be returned to the seller in good condition, other than the specified problem, at the buyer's expense. The owner will then qualify for a replacement puppy. Buyer is responsible for transportation costs to and from the seller on a replacement puppy. Seller will not pay or be responsible for any veterinarian bills. Moreover, if you decide to keep and treat a pup with a genetic defect or an ill puppy, seller will void all aspects of this contract.

The guarantee applies to the original puppy purchaser only and is non-transferable to a second party. This puppy must not be re-sold to any owner, agent or individual connected with a pet shop or wholesaler of pure-bred dogs in the United States or any other foreign country.

NO replacement puppy will be covered under this guarantee if the puppy has sired or whelped one or more pups.

Replacement puppy will be mutually agreed upon by both parties and will be of comparable quality. It is understood that the replacement puppy may not be from the exact same parents of the original puppy.
There are certain disorders that may be caused by environmental factors, for example: allergies, thyroid dysfunction, demodectic mange, and other autoimmune disorders that are not covered by this guarantee.
Physical problems that are or could be the result of injury, abuse, neglect, or if the buyer fails to complete vaccinations and puppy checks by a qualified Vet, are not covered under this guarantee.

Proof of said maintenance must be furnished upon request of breeder.

Although our puppies are bred to AKC standard, and most have excellent conformation, we can make NO guarantees of "Show Quality.”  Our main concern and objective is to raise beautiful, healthy companions.  We also cannot guarantee adult size, color or temperament. While we do our best to give an accurate adult weight, there is absolutely NO GUARANTEE that the puppy will be the estimated size, or color. Coats and color may change.

There is no guarantee or warranty that the Buyer will be able to show or breed the puppy regardless of show or breeding potentials. Retained testicles and hernias are not covered by this guarantee.

The buyer understands that this puppy is being sold/guaranteed as a pet only. This puppy will not be bred.
If the buyer should decide for any reason, at any time during the life of the dog, not to keep the above mentioned dog, he or she is to notify the breeder who will have first option to re-purchase the dog at no more than the original purchase price, minus any expenses incurred in placing or reconditioning the dog. It is possible that the buyer may have to take less that the original purchase price depending upon the age, training, and condition of the dog. If the breeder refuses her first option the breeder will gladly assist with re-homing the dog. If the dog is returned to the breeder then all costs to return the puppy/dog will be assumed by the owner.

The puppy must be kept in a trim weight – appropriate to its size and age – especially avoiding obesity. If the dog is found to be obese then the contract is null and void.

Pet puppies should be neutered – preferably males no earlier than ten months/one year. Females at eight/ten months. This contract will be null and void if puppies are altered before suggested time frame.

The puppy is not allowed to jump up or down from places higher than its shoulder, or made to jog/run un-naturally (as in running nesy to a bike) up until eighteen months of age. These conditions have been shown to bring about joint damage to puppies still growing when their tender joints are most susceptible to damage.
Pet puppies are registered with the AKC Limited Registration and are allowed participation in AKC Field and Obedience events with the exception of show events. Limited Registration can be reversed by the breeder after evaluation by the breeder and dog has received all clearance – OFA hips, CERF, OFA heart, OFA elbows and the breeder determines that the puppy is of breed/show quality.

This contract supersedes any and all previous agreements.

This contract is null and void if the terms and conditions are not fulfilled, including taking your new puppy to the vet within 72 hours and mailing this signed contract back along with the original vet statement with date and signature of your vet.

Buyer agrees that he/she understands this contract fully, and that this contract is under the jurisdiction of the State of North Carolina, in the county of Guilford. It is agreed that the place of venue shall be in Guilford County, North Carolina and that all legal and other related fees are the buyer’s responsibility if it is determined that this contract has been violated by the buyer.
